Komisja Europejska ogłosiła 30 czerwca br. konsultacje publiczne poświęcone neutralności sieci i otwartego Internetu. Konsultacje mają charakter otwarty i mogą brać w nich udział wszystkie zainteresowane strony – mi.n. dostawcy usług i treści, użytkownicy, przedstawiciele sektora, instytucje badawcze. Termin nadsyłania stanowisk upływa 30 września br. Odpowiedzi otrzymane przez Komisję Europejską zostaną wykorzystane w przygotowywanym przez Komisję Europejską raporcie na temat neutralności sieci, którego publikacja przewidziana jest przed końcem tego roku.
Kwestionariusz składa się z 15 pytań:
- Czy pojawiają się obecnie w Europie problemy związane z neutralnością sieci i otwartym Internetem? Jeżeli tak, prosimy podać konkretne przykłady.
- Czy istnieją wąskie gardła i jakie? Czy istnieje możliwość rozwiązania tych problemów w oparciu o obecny poziom konkurencyjności zarówno na rynkach dostępu mobilnego jak i stacjonarnego?
- Z jakimi problemami należy się liczyć w przyszłości? Czy mogą pojawić się one w innych miejscach internetowego łańcucha wartości? Jakie byłyby ich przyczyny?
- Czy takie problemy można rozwiązać na gruncie ram regulacyjnych, mając na uwadze monitorowanie/ocenę i późniejsze egzekwowanie?
- Do jakiego stopnia z punktu widzenia operatora konieczne jest zarządzanie natężeniem ruchu w sieci? W jaki sposób jest to przeprowadzane w praktyce? Jakie technologie używane są do kontroli natężenia ruchu w sieci?
- W jakim stopniu zasady przejrzystości informacji dla użytkownika końcowego mogą przyczynić się do rozwiązywania problemów związanych z neutralnością sieci? Zasady te odróżniają tzw. usługi zarządzane od usług umożliwiających publiczny dostęp do Internetu dostarczanego na zasadzie „dokładania wszelkich starań”
- Czy zasady regulujące zarządzanie natężeniem ruchu w sieci powinny być takie same dla sieci mobilnych i stacjonarnych?
Czy są stosowane jakieś inne formy priorytetowania?
- Czy dostawcy treści i aplikacji także próbują priorytetować swoje usługi? Jeżeli tak, w jaki sposób takie działania wpływają na innych uczestników w łańcuchu wartości?
- Czy w przypadku usług zarządzanych powinny być dostępne te same warunki i parametry jakości usług dla wszystkich dostawców treści/aplikacji/usług online będących w takiej samej sytuacji? Czy umowy na zasadzie wyłączności pomiędzy operatorami sieci i dostawcami treści/aplikacji/usług online mogą stać na przeszkodzie w osiągnięciu tego celu?
- Jeżeli cel do jakiego odnosi się pytanie 8 jest zachowany, czy podjęcie dodatkowych kroków jest potrzebne aby go utrzymać? Jeżeli tak, to czy powinny one być dobrowolne (w postaci na przykład sektorowego zbioru zasad) czy też mieć charakter regulacyjny?
- Czy warunki handlowe, które obecnie regulują zasady dostępu do Internetu są wystarczające dla zachowania otwartego charakteru Internetu i podtrzymania inwestycji infrastrukturalnych? Jeżeli nie, jak powinny się zmienić?
- W jakich przypadkach krajowe organy regulacyjne ustalałyby wymagania dla minimalnej jakości usług dla przedsiębiorstwa lub przedsiębiorstw dostarczających publiczne usługi telekomunikacyjne?
- W jaki sposób można określić wymagania jakościowe dla usług oraz w jaki sposób mogłyby być monitorowane?
- Jeżeli NRA uznają za niezbędne, aby określić minimalne wymagania co do jakości usług, jaką formę powinny przyjąć oraz w jakim zakresie NRA powinny współpracować, aby wypracować wspólne stanowisko?
- Jakie elementy powinny się składać na zapewnienie „przejrzystość dla użytkownika”? Czy obecnie istniejące standardy powinny być polepszane?
- Czy poza zarządzaniem natężeniem ruchu w sieci opisanym powyżej istnieją w Internecie inne zagrożenia dla swobody wypowiedzi, pluralizmu mediów i różnorodności kulturowej? Jeżeli tak to jakie kroki należałoby podjąć w przyszłości aby chronić te wartości?
