Reserved zawarło ugodę w sprawie plagiatu na koszulce?

Jakiś czas temu Amerykanka Rockie Nolan zarzuciła właścicielowi marki Reserved, że bezprawnie wykorzystał jej zdjęcie z internetu na swojej koszulce. Opinię publiczną zbulwersował nie tyle ten fakt, co zaproponowane przez polskiego giganta odzieżowego zadośćuczynienie za plagiat: 150$. Już zapowiadało się na proces, jednak strony chyba się ostatnio dogadały…
“- Nazywam się Rockie Nolan. Jestem 19-latką mieszkającą w USA. Poinformowano mnie ostatnio, że duża firma odzieżowa Reserved sprzedaje koszulki z moim zdjęciem” – to fragment wpisu z blogu dotyczącego ochrony praw autorskich. Według autorki zdjęcie jest jej autoportretem, który był dostępny w internecie, a firma LPP splagiatowała go na swoich koszulkach. O sprawie pisałem w czerwcu (tam też zdjęcia – porównanie oryginalnego dzieła i plagiatu).
Amerykanka na swoim blogu sugerowała, że rozważa pozew przeciwko właścicielowi marki Reserved. Uznała bowiem przedstawioną przez LPP S.A. propozycję finansową za obraźliwą.
Przypuszczalnie jednak strony zawarły ostatnio cichą ugodę. Świadczyć o tym może następujący wpis Rockie na Facebook’u:
For those who were following the case with Reserved, I am pleased to say everything has finally been settled. Can’t release any information about what the settlement entailed, but do know that it has been resolved!
Z ciekawostek warto zauważyć, że autoportret Amerykanki został twórczo obrobiony na potrzeby nadruku na koszulce. Takie opracowanie można uznać za tzw. dzieło zależne, utwór chroniony odrębnie przez prawo autorskie – niezależnie od ochrony utworu pierwotnego (choćby nawet prawa do niego zostały naruszone).
