Firma Eolas, znany troll patentowy, pozwał wiele serwisów internetowych, mniej lub bardziej związanych z samą branżą internetową, za bezprawne używanie zastrzeżonej przez nich technologii “fully interactive embedded applications”, nazywaną szerzej AJAX-em.
Po batalii z Microsoftem kilka lat temu, firma Eolas “unowocześniła” swoją broń – czyli patent nr 5,838,906. Został on odpowiednio zmodyfikowany (głównie poprzez dodanie kilku słów i zdań w kluczowych miejscach) i dostał nowy nr: 7,599,985.
Firma w treści pozwu wyjaśnia o co chodzi:
Patent ’985 to kontynuacja patentu ’906, umożliwia on dodawanie w pełni interaktywnej aplikacji do swojej treści poprzez używanie wtyczki oraz technik AJAX’owych.

Wiem, że tytuł bardzo przewrotny, lecz w obecnych czasach zdecydowana większość stron internetowych używa owych opatentowanych technologii, stąd dotyka to niemal każdego większego gracza.

I sami się przyznają, że są trollami

A pani jadzia też miała patent na pozywanie innych. Problem tylko, że nigdzie w jej małej wiosce nie było sądów.
Aha – chciałbym zobaczyć tę ich technologię w akcji lub przynajmniej szczególy jej działania. Pisarzem Science Fiction może nie zostanie każdy(trzeba mieć trochę wiedzy), jednak z pewnością można tam opisać wszystko – nawet, że ziemia jest płaska(po zderzeniu z czymś dużym).
A ja kibicuję temu całemu Eolasowi. Może jak wygrają, to ludzie pojmą głupotę istnienia p.a.
Może nie pojmą, bo zamkną cały internet, co wykorzystają stacje telewizyjne do zasiania nienawiści do internetu

Widać jeszcze w USA nie opanowali technologii rozwiązywania problemów z trolowymi szkodnikami przy pomocy Saszy i Dimitrija – negocjatorów z Gruzji lub Ukrainy
Śmieszny ten ich system patentowy. Ja rozumiem aby uściślić patent i stwierdzić:

to jest nasz patent.
Ale ten ich system pozwala na zbytnie uproszczenia. Gdyby trzeba było być tak precyzyjnym to ja rozumiem że bronią swojego kodu a nie pomysłu. Bo taki sam pomysł każdy może mieć ale wykonanie inne.
Pomysł to patent, szczegółowe wykonanie to prawo autorskie.
Prawo patentowe conajmniej trzeba poważnie zreformować a najlepiej by było ograniczyć je do minimum .
Prawda jest taka że ono poważnie spowalnia i ograniczna rozwój nie tylko w informatyce ale też w innych dziedzinach nauki , szczególnie medycynie .
Podam przykład coraz czesciej zdarza się że jakaś firma wynajdzie lek np. na nowotwór , dostaje patent na 10 lat , druga firma podmieni tylko trochę cząsteczke np stworzy jej izomer i również dostaje patent tylko pod inną nazwą w efekcie przez 10 lat nikt nie może stworzyć znacznie tańszego substytutu , korporacja się dorabia a pacjent płaci o wiele za dużo
Podobnie jest z patentami w informatyce , ciekaw jestem jakbyśmy byli zacofani gdyby np. 90% technologi licencjonowanych jako bsd było opatentowanych …
Tylko, że ta "zła" korporacja musi zainwestować miliony $ na badania … Taki drobny szczegół, który jakoś często umyka. Patenty w informatyce to trochę inna skala, ponieważ nikt nie zginie od testowania kodu.

To niech nie robi łaski i nie inwestuje, jak jej szkoda i nie liczy, że dostanie monopol.
No to sam zainwestuj w długoletnie badania. Broni ci ktoś ? Zarobisz miliardy i będziesz miał monopol. Firma nie robi nikomu łaski, że inwestuje.
Jeśli chodzi o substytut, to inni też mogą zainwestować i prowadzić badania. Tylko niech nawet nie próbują dotknąć opakowania z lekiem konkurencji i sami wszystko wymyślą, tak jak musiał zrobić wynalazca leku.

Jestem przeciw monopolom, bo to czyste złodziejstwo.
Firma może robić sobie, co jej się żywnie podoba (oczywiście w granicach prawa), ale nie może oczekiwać, że państwo "wykosi" jej konkurencję.

Jakby nie patrzeć zrobienie patentów załóżmy na 5 lat zamiast 10 będzie bardziej korzystne dla kieszeni klijentów , a jednocześnie będzie chroniło pieniądze które włożył producent na badania .
Co do informatyki to chorych patentów będzie coraz więcej i one będą hamować jej rozwój coraz mocniej i dotkliwiej . Jeśli już mają być w tej dziedzinie patenty to maks na 2 lata .
