Mam już dość bezsensownych patentów, które hamują rozwój alternatywnego oprogramowania!
A gdzie Ci ten patent (i wiele innych) hamują rozwój oprogramowania? Raz że te patenty obowiązują tylko w stanach, dwa nie sądzę żeby Microsoft chciał za taką pierdołę pozywać. To raczej ucieczka do przodu, żeby jakiś troll patentowy tego nie opatentował i nie pozywał firmy z Redmond.
No sam wymieniles kilka powodow, gdzie to hamuje rozwoj oprogramowania:
- USA to olbrzymi rynek oprogramowania – ktos, kto chce istniec globalnie, nie moze wycofac sie z tego kraju,
- zamiast inwestowac pieniadze w rozwoj, pieniadze inwestuje sie w biurokratyczna machine patentowa (ktos musi wniosek napisac, udokumentowac, bronic – w tym samym czasie za te pieniadze ktos moglby myslec nad rozwojem oprogramowania),
- Microsoft za taka pierdole dzis pewnie nie pozwie, ale co bedzie jutro? Patrz Oracle – Google i Java.
Haha, chyba zacznę kibicować Microsoftowi, swojego przyjaciela Linuksa nie będzie pozywał na pewno, a za to trochę oklepie tyłek Apple i Google, haha. Tak, przedawkowałem.

W dziedzinach takich jak leki, moralność powinna mieć wyższy priorytet od maksymalizacji zarobków.
Nie masz racji. W Europie ponad 90% kosztów badań nad nowymi lekami dla największych firm jest finansowanych przez UE. Czyli nawet z patentami się nie opłaca, a może nawet bardziej się nie opłaca. Gdyby nie patenty, to jakaś mała firemka, co nie dostaje bajońskich sum z pieniędzy podatników, stosowałaby tanie sposoby na wymyślanie leków. To by z kolei wykazało, że finansowanie z budżetu państwa nie jest potrzebne.
Obecnie jest tak, jak za komuny:
a) Firmy mają monopol
b) Firmy są finansowane ze strony państwa

Ten patent jest nieważny. W Europie nie dostali by takiego patentu, bo u nas są sprawdzane przez specjalistów nie to co w stanach. Wniosek złożony w 2005, a z tego co pamiętam takie rozwiązania już były stosowane wtedy.
Warto poczytac też „references cited” z podlinkowanego wyżej patentu.
Niedawno dowiedziałem się że Gates ma patent na dwuklik i nie pobiera żadnych opłat a nawet nikogo nie zaskarżył (patent może nie jest ważny w Europie ale w Stanach na pewno). Cóż – chore amerykańskie prawo patentowe wymusza patentowania przez firmy technologiczne nawet takich rzeczy aby ustrzec się przed pozwami i wypłatami odszkodowań. Opensourcowych, darmowych systemów żaden troll patentowy i tak by się nie czepiał (bo i tak by niewiele mógł dostać – najwyżej Ubuntu wyłączałoby się sprzętowym przełącznikiem), ale taki Windows byłby na celowniku.

No to nie pamiętam czy już w 2005, ale teraz mam takie coś w linuksie. Poza tym nie dziw się, że niektórzy oceniają po tytule.

Jak ominąć patent w USA? Z korzyścią dla użytkownika! – hibernujmy system. Można w zasadzie zamiast zabijać procesy zapisywać je na dysk. I to bez swapu czy coś tam.
