10.000 albumów na Jamendo!

Każdy, kto interesuje się muzyką i wolną kulturą, musiał słyszeć o Jamendo. Ten pierwszy międzynarodowy serwis udostępniający muzykę na licencjach Creative Commons i pokrewnych opublikował już ponad 10 tysięcy albumów.
W tej liczbie znalazła się także pokaźna kolekcja albumów nagranych przez polskich wykonawców. Dwa lata temu były tam zaledwie dwa takie albumy, a dziś obchodzimy także małe święto, ponieważ licznik właśnie wybił 300!
Luksemburska (a nie francuska, jak głoszą plotki) firma Jamendo SA, która prowadzi ten serwis, także się rozrosła i obecnie zatrudnia już około 20 osób. Wśród nich jest mieszkająca za granicą Polka, zajmująca się sprawami biznesowymi, oraz polskojęzyczna Węgierka, która między innymi opiekuje się polską społecznością.
W innych kategoriach statystyki Jamendo prezentują się równie imponująco. Korzysta z niego ponad 2 miliony użytkowników, z czego 350 tysięcy zarejestrowanych (5 tysięcy z nich to artyści), a codziennie notuje się aż pół miliona pobrań z ogromnej puli 150.000 utworów.
Rozwój serwisu bynajmniej się nie zatrzymał. W tym roku Jamendo przeszło metamorfozę strony WWW, a kilka dni temu pojawił się nowy widget muzyczny, który można wstawiać na swoich stronach. Także artyści chętnie publikują tam swoją muzykę – każdego tygodnia na stronach Jamendo pojawia się 300 nowych albumów.

Wszystkie autorskie niusy w serwisie publikowane są na licencji Creative Commons Uznanie autorstwa 2.5 Polska.
Fajnie było by wiedzieć jeszcze ile z pośród tych albumów zostało opublikowanych na wolnych licencjach.
Z tego co rozumiem ideę Jamendo, to wszystkie albumy tam publikowane są wydane na wolnych licencjach.
Ja zawsze myślałem że są też na licencjach dających tylko parę zezwoleń, ale często niepozwalających na bliżej niezdefiniowane użycie komercyjne, czy dystrybucje utworów zależnych.
To zależy co kto rozumie pod pojęciem "wolna licencja". Ja np. uważam, że wolna licencja to taka, która pozwala na dowolne wykorzystanie, czyli np. ND i NC tu nie wchodzą.
A określić te liczbę łatwo – w wyszukiwarce są dodatkowe pola właśnie pozwalające odfiltrować NC, ND – albo oba naraz:

Wychodzi 1843 takich, które pasują do tej węższej definicji.
Ja zawsze spotykam ta samą definicje:
Wolność dowolnego wykorzystywania, modyfikowania (w tym opracowywania utworów zależnych), oraz dystrybucji kopii i utworów zależnych.
Znasz jakąś inną definicje, czy inna to ruch na rzecz darmochy?
Czyli jednak mamy ruch na rzecz darmochy, bo ponad 80% muzyki nie nadaje się do użytku w szeroko pojętej wolnej kulturze. Gdybyśmy ktoś chciał użyć jej np. w filmie, to takiego filmu albo nie można by opublikować w ogóle, albo nie można by go puścić w kinie, czy wydać na DVD. Taki mały skutek utorzsamiania CC z wolną kulturą:/
W takim wypadku odfiltrowanie "Wykorzystania komercyjnego" (lepiej w końcu zapłacić autorowi za taką możliwość, niż bez niczego wziąć to, co stworzył) daje wynik 7411 albumów. Z nimi można robić wszystko, oprócz właśnie wykorzystania komercyjnego.
To chyba też może podchodzić pod definicję wolności.
Wolności w sensie "wolno ci to na co ci pozwolono" owszem, wolność użytkownika jest prawie zachowana. Problem w tym, że do budowania wolnej kultury się to nie nadaje. Jeśli będziesz chciał użyć w filmie muzyki jednego autora problem jest mały.
Gorzej jeśli prawa autorskie do tekstu piosenki należą się czterem spadkobiercą autora wiersza, na którego podstawie ktoś napisał piosenkę i autorowi tekstu piosenki (działa zależnego), muzyka została skomponowana już wcześniej, prawa autorskie należą się sześciu wnuką kompozytora, ktoś odegrał to i wypuścił jako karaoke, a dopiero potem ktoś nagrał śpiew i wypuścił całość, przy czym w filmie potrzebujemy więcej niż jednej piosenki, a sam,a muzyka jest tylko ułamkiem potrzeb. Może być problem z dogadaniem się ze wszystkimi.
Czy przypadkiem wolna kultura nie miała powstawać na podobnej zasadzie?
Pocieszające może być to, że Polskie albumy wypadają tu lepiej od reszty świata. Wśród wspomnianych 300, 76 wydano na wolnych licencjach.

W ulubionych mam chyba większość albumów try^ad
Średnia jakość muzyki w Jamendo to 2/10, także z tych 10 tys. albumów nie ma się co cieszyć. Nawet, gdy znajdą się utalentowane indywidualności, to nie ma sensu, aby publikowały wśród tych 10 tys. albumów.
Niemniej jednak Jamendo vel "kult amatora" pozostaje bardzo użytecznych narzędziem do… niskobudżetowych podcastów

Zgodnie z tą logiką z miliardów stron WWW też nie ma się co cieszyć, bo zaledwie ułamek procenta to są rzeczy dobre, a jeszcze mniej te, które mnie interesują. I wiadomo, że utalentowani ludzie to piszą książki (drukowane) albo do gazet (też drukowanych), więc cały ten Internet nie jest warty uwagi… =}
A ja się jednak cieszę, bo to znaczy, że serwis stał się szeroko rozpoznawalny i dla wielu ludzi pokaże nowy kierunek. Nawet jeśli wolnej kultury jest w nim tylko ~20%, to i tak w liczbach bezwzględnych znacznie więcej niż gdziekolwiek indziej. W dodatku serwis prowadzi człowiek, który dobrze wie co to jest FLOSS i CC, więc może w przyszłości dokona jakiegoś "zwishenrutu" w kierunku większej wolności.
Moim zdaniem nic im to nie zaszkodzi, bo jak serwis stanie się "marką" (a już nią jest dla dużego grona słuchaczy, a nawet artystów – vide te 43 nowe albumy dziennie!), to nie ma znaczenia jakie dyktuje warunki. W większości jak ktoś chce coś opublikować na danym serwisie, to przyjmie każde warunki. Dwa przykłady: LinuxNews i OSnews nie cierpią na brak nowinek od ludzi tylko dlatego, że publikujemy niusy na CC BY 2.5 PL, czyli z minimum ograniczeń. Podobnie Wikipedia nie usycha tylko dlatego, że można ją wykorzystywać komercyjnie.
Uważam, że przeciętny artysta najpierw chce opublikować na Jamendo, a potem dopiero jak ma przyciski "zastrzeż", to zastrzega. Jeśli będzie miał do dyspozycji tylko opcje PD, CC BY i CC BY-SA/GFDL, to też w 9/10 przypadków się nie wycofa. Postaram się o tym pogadać z Sylvinusem któregoś dnia, chyba że ktoś spróbuje go przekonać wcześniej, to niech da znać – chętnie się włączę.
A tak a propos – jeśli sztuka jest niewolna, to nie każdy się na to burzy, vide RMS:

To trochę mnie zaskoczyło. Jeśli tylko z 5% tej wizji się nie zgadzasz (z którymi?), to właściwie aż się dziwię co tu robisz. Dla mnie to proste – olewam całe morze rzeczy, które mnie nie interesują, i korzystam z tego, co mi akurat leży. I to mnie cieszy – tak samo jak to, że nie ma obowiązku korzystać z całej reszty.
Jamendo też nie zmusza mnie do słuchania wszystkiego, a te kilka pysznych rzeczy, które tam sobie znalazłem to szczerze mam w nosie czy jest „amatorskie” czy „profesjonalne” (to w ogóle jakiś abstrakcyjny podział, który miał sens tylko do czasu, a teraz jest głównie zużytą kalką myślową). Często zresztą łapię się na tym, że to nie mój gatunek, więc słuchać nie chcę, ale czuję, że muzyka naprawdę porządna, jak z „wysokobudżetowego podcasta”…
Dziwi mnie, że muszę rozwijać ten wątek. Przecież Internet jest zapełniony ogromną ilością treści, z których niewielki ułamek reprezentuje jakąś jakość, a jeszcze mniejsza ich część jest recenzowana.
A ponadto wysoce zaburzone są proporcje tematyczne. Internet zajmuje się przede wszystkim sobą, natomiast inne sprawy pozostawione są na marginesie. Tu prawie nie ma miejsca na ważne książki lub dyskusje intelektualne, które Internetu nie dotyczą.
Czy ktoś się łudzi, że jest inaczej? Taka świadomość medialna powinna być punktem wyjścia do skorzystania z tego medium.
I pytasz jeszcze co ja tu robię? Ano 70% czasu zajmuje mi dotarcie do informacji, które nie są chłamem lub miernotą, pozostałe 30% mam na zapoznanie się z nimi.
IMHO najlepszą dla mnie kombinacją w licencji CC jest by-nc-sa – na takiej publikuję moje zdjęcia i teksty – raz, że nie podoba mi się jeśli ktoś miałby zarabiać na tym co zrobiłem i puściłem za free, a dwa, to ta licencja ma taki GPL'owy feel
.
Ja używam darmowo mnóstwo fajnych rzeczy, także w pracy, więc i sam staram się też nie wprowadzać nadmiernych ograniczeń. Zwłaszcza, że ja od tego nie zbiednieję, a interpretacja tego co jest "komercyjne" i "pochodne" przyprawia o ból głowy…
Natomiast nie mogę się zgodzić, że CC NC-SA ma "GPL-owy feel". Pomyliłeś się – ma go raczej CC BY-SA (i są poważne plany, że w przyszłości CC BY-SA stanie się wzajemnie kompatybilna z GFDL). GPL miał szanse na sukces właśnie dlatego, że nie ograniczał dzieł na tej licencji do getta hobbystów.
Duzych szans na kompatybilnosc nie widze chociazby dlatego, ze w GPL nie ma nic o "attribution".
GPL jak najbardziej zawiera wymóg "attribution": "…provided that you conspicuously and appropriately publish on each copy an appropriate copyright notice" (GPLv3, podobne zastrzeżenie w GPLv2).
Jeśli już to GFDL, nie w GPL, bo to ta licencja ma być kompatybilna z CC BY-SA. A ponieważ:

to znaczy, że jeszcze nie ma się co spieszyć z tym sprawdzaniem, bo mowa dopiero o przyszłych wersjach.
Co do zdjęć to równie dobrym i IMO bliższym duchem GNU jest by-sa i obcięcie rozmiaru do wymagań dla oglądania na ekranie. Wtedy jeśli ktoś chce cokolwiek to może z zachowaniem licencji, a jak bardzo zapragnie zarobić na plakacie kupę $ to i tak poprosi o wersję w rozdzielczości nadającej się do druku … i tu jest moment na negocjację warunków.
Na tej samej zasadzie wikipedyści polecają licencje GFDL. Jeśli ktoś chciałby coś przekazać na czymś w rodzaju NC, to tłumaczą że w Wikipedii akceptuje się tylko grafiki na wolnych licencjach, ale jak ktoś udostępni na GFDL to np. do druku i tak się to nie nadaje, bo kto widział np. pocztówkę z dołączonymi kilkoma stronami licencji.
